Using Casewire

Casewire at rss.cascient.com, including the Casewire iPhone app, is run by Campbell Herbert ("me", "I"). By creating an account or using Casewire, you agree to these terms. If you don't agree, don't use it. Simple.

What Casewire is

Casewire republishes RSS feeds of judgments that courts and tribunals publish, from their own websites or the services they use to publish them, and lets you read, follow, search, summarise and be notified about them. It's a convenience tool that I built and run myself. It is free, and it is not an official source of any judgment.

No guarantees

Casewire is provided "as is" and "as available". I don't promise anything about it. In particular, I don't guarantee that:

• it will be available at any particular time, or at all. It may be slow, go down, lose data or stop working without notice;
• it includes every judgment, or includes them promptly. Feeds can miss, delay or duplicate items, and sources change or disappear;
• anything it shows is accurate or complete: titles, case names, courts, citations, dates, text and links all come from, or are worked out from, the sources and may be wrong;
• notifications, digests or alerts will arrive, arrive on time or include everything relevant;
• search finds every judgment that matches, or only those that do;
• any feature will keep working the way it does now, or keep existing. I may change, suspend or withdraw Casewire, or any part of it, at any time.

Always check anything that matters against the official judgment from the court or its official publisher.

AI summaries

Summaries are written automatically by an AI model (which I didn't create and do not maintain). They can be wrong, incomplete or misleading, even when they look confident, and they aren't checked by a person. They're a quick guide to whether a judgment is worth reading, not a substitute for reading it.

Not legal advice

Nothing on Casewire is legal advice, and using it doesn't create any professional relationship between us. Don't rely on it in place of your own reading of the judgments and your own professional judgment.

Judgments and other people's content

The judgments belong to, and are published by, the courts and others, under their own terms (in England and Wales, for example, The National Archives' licence for Find Case Law). Casewire provides links to the original, it doesn't serve that original to you. If you reuse judgments, it's up to you to follow the terms that apply to them.

Your account

• Keep your password and your personal feed links to yourself. Anyone with your feed links can read your feeds.
• You're responsible for what happens under your account.
• I decide who can register, and I may suspend or delete any account at any time, for any reason at all, and regardless of whether you have in fact breached these terms.
• You can delete your account at any time, on your account page or in the iPhone app.

Using Casewire fairly

Please don't misuse Casewire. In particular, don't:

• try to get into accounts or parts of it you're not meant to;
• overload it, scrape it in bulk or interfere with how it works;
• use it for anything unlawful, or to harass or harm anyone;
• resell it or give others access to your account.

If I think you're doing this, I'll just take the whole thing away and no one will have it. You'll then have to live the rest of your life knowing you are a spoil sport.

Liability

Casewire is free and comes with no guarantees. So, as far as the law allows, I'm not liable for any loss or damage arising from using it or not being able to use it, or from relying on anything it shows or sends, including AI summaries. That includes, for example, missed judgments, deadlines or opportunities, lost profits or data, and any indirect or consequential loss.

Nothing in these terms limits liability that the law doesn't allow to be limited, such as for death or personal injury caused by negligence, or for fraud. If you use Casewire as a consumer, these terms don't affect your legal rights as a consumer.

The iPhone app

These terms apply to the app too, alongside Apple's standard licence terms for apps from the App Store. Apple isn't responsible for Casewire or for supporting it.

Changes

I may change these terms. I'll update them here and change the date at the top, and for significant changes I'll let account holders know by email. If you keep using Casewire after a change, you're agreeing to the new terms.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them. At any point, including after you have commenced proceedings in England in respect of a dispute, I can require that any dispute (including any pending dispute) be referred to arbitration before a sole arbitrator in England under the LCIA Rules and you agree that I will be entitled to a stay of any pending proceedings. You also agree that irrespective of whether you succeed (or partly succeed) in any claim (a) you will bear all of the costs of the proceedings (including without limitation any tribunal fees or expenses or administrative fees), and (b) you shall not be entitled to recover from me any of your costs, including legal fees, incurred in connection with those proceedings.
